拉下中運公司遮羞布 高等法院確認「特別獎金」即工資
中鋼運通公司最後一塊遮羞布也正式被扯了下來!
高等法院高雄分院最新的110年勞上字第36號判決表示:「可見特別獎金一為船員在船上提供勞務(特別工作)之對價性給與,具有勞務對價性,且中鋼運通公司對在船船員均會依照船員職務不同而發給特別獎金一之情,業據中鋼運通公司陳明在卷,可見此項給與具經常性,故特別獎金一應屬勞基法所稱之工資,應列入平均工資計算退休金。」
工會必須嚴正地呼籲中鋼運通股份公司,全世界沒有任何見解支持船員的「特別獎金(一) 」不屬於工資之見解,切莫一意孤行,應該尊重我國法律、作好身為雇主最基本的法律底線,馬上補足15年來積欠船員至少上億元的勞退金提撥,還給船員一個最低的退休保障!

The Kaohsiung High Court, in its latest ruling (Case No. 36, 2021), has affirmed that "Special Bonus I" qualifies as wages under labor law. The court determined that this bonus is a direct payment for seafarers' work onboard, regularly distributed based on rank, and must be factored into the average wage calculation for retirement benefits.
No legal interpretation anywhere supports China Steel Express’s claim that "Special Bonus I" does not constitute wages. The union strongly urges the company to comply with labor laws and immediately pay the NT$1 billion in overdue retirement contributions accumulated over the past 15 years. Seafarers deserve at least the minimum retirement security rightfully owed to them.
