守得滿夜暴雨見晨曦 高等法院改判挺勞工

今天高等法院高雄法院終於作出正義的判決結果,中鋼運通公司確實短少給付關松屏輪機長***311萬餘元***退休金!工會要求中鋼運通公司應依勞基法、船員法盡速補足關輪機長退休金,中運公司違法事實明確,請勿再拿納稅人胡亂上訴糾纏!

中運公司過去以年資不連續、特別獎金不計入工資的方式苛扣勞退舊制船員退休金,關輪機長自1998年服務於中運,在職期間殫精竭慮,屆退之際仍逃不過被中運無情苛扣退休金。在與工會的並肩作戰下與公司纏訟多年間,迭經高雄地方法院判決勝訴後,上訴審高等法院高雄分院法官卻罔顧勞資現實、片面聽取資方說詞,直到最高法院撤銷錯誤判決、發回高院重新審理,最終才能獲得今天的判決!

歷經三年訴訟煎熬,工會靠著關輪機長的堅持,以及蔡晴羽律師帶領的圓矩團隊,終於說服高等法院接受中鋼運通的行為就是苛扣退休金,就是違反法律!輪機長已是編制上最高等級,對於輪機長而言311萬元只需一兩個契約就能賺到,何苦要堅持三年,之所以走向訴訟完全不是為了錢,是要為了要揭發中運管理層的醜惡面具,為了往後千千萬萬的海運後輩站出來討公道,關輪機長深知唯有作為烈士承受痛苦,站出來改革,不公不義的公司制度才有辦法被打破重造,對此工會對具有利他精神的關輪機長致上無上的敬意,也以工會有關輪機長這樣的會員為傲!

然而本次判決並不只是關輪機長的勝利,在過去工會協助所有的退休金案件,都面臨一審全贏二審全輸的局面,所有的案件都無一例外敗在高等法院高雄分院,高等法院不但否認在岸年資,連船員辛苦換來的特別獎金都不被當成工資,隨著工會這幾年來努力喚起各界對於船員的重視,船員勞動議題成為討論熱點,真正的船員現況得以被社會所知悉,所謂時勢造英雄、英雄造時勢,隨著社會輿論與蔡晴羽律師傑出的訴訟能力,正道乘勢而去必將勢如破竹,終於突破鐵板一塊的高等法院高雄分院見解,讓一切撥雲見日!

本判決也是全台灣商船船員歷史性的勝利!關松屏案是台灣第一件、也是至今唯一一件從第一審到第三審都有勝訴的船員案件,這為了工會主張的船員不定期契約雇用體制正當性基礎進行背書,若不是如此,中運何來短少的311萬退休金?本次的高院判決掃除了一道阻擋船員的高牆,當法律不再是阻害,便無任何阻礙可以阻止船員前行,船員問題終將決戰於廟堂,止戰於台灣船員們的完全勝利,屆時各位一定會享有不定期保障,享有真真正正與岸上勞工一樣的勞動尊嚴,成為堂堂正正的台灣船員,未來希望各位弟兄跟工會一起來改變船員的勞動環境!

The High Court Kaohsiung Branch has delivered justice—China Steel Express owes Chief Engineer Kuan Song-ping over NT$3.11 million in unpaid pension! The union demands immediate compliance with labor laws and warns the company not to waste taxpayer money on unnecessary appeals.

China Steel Express systematically withheld pensions from veteran seafarers by excluding special bonuses from wage calculations and claiming employment gaps. Chief Engineer Kuan, who served the company since 1998, fought back after being unfairly denied his retirement benefits. Despite winning multiple rulings in the lower court, the High Court Kaohsiung Branch sided with corporate interests—until the Supreme Court overturned the biased decision and ordered a retrial.

After three years of legal battles, the court finally acknowledge China Steel Express illegal pension deductions. The case was never about money—it was about exposing management's injustice and fighting for future generations of Taiwanese seafarers. 

This ruling is historic for Taiwan's merchant seafarers! Previously, all union-led pension cases were victorious in lower courts but lost at the High Court Kaohsiung Branch. The court repeatedly denied shore-based seniority and refused to classify special bonuses as wages. But thanks to years of advocacy, public awareness, and attorney Tsai Ching-yu's legal expertise, the tide has turned. The precedent set today shatters long-standing barriers in maritime labor rights.

The Kuan Song-ping case is Taiwan's first and only seafarer lawsuit to win at all three judicial levels, reinforcing the union's push for indefinite employment contracts in maritime work. Seafarers must stand together and reshape Taiwan's maritime labor system!
